The Navarre Court has ruled that the man, detained over his wife's death in Zizur Mayor last July, shall serve pre-trial detention at the home designated by his family under supervision through an electronic monitoring device. This follows the judicial report that confirms his cognitive deterioration, which led to his incarceration status being reconsidered. The case was initially investigated as gender-based violence, drawing criticism from the family and confirmation by the Ministry of Equality. The Civil Guard had detained the man after his call to 112, in which he displayed incoherent speech.
Regarding the judicial decision, the defense's challenge to the validity of pretrial detention was rejected, because the initial ruling was motivated by the risk of flight and destruction of evidence. However, the Court considered that the detainee's age and the condition of the dwelling minimize these risks. A neurological report demonstrated their vulnerability and incapacity to make autonomous decisions, which has weighed on the decision to switch from conventional imprisonment to home confinement. The Court has not yet determined whether the case is murder or accidental death, pending toxicological analyses and other elements.
