The Investigating Court No. 5 of Estepona has confirmed the existence of irregularities in the process of enrolling new members in the local PSOE during 2020. In a ruling issued in May 2025, the court found that during the investigation there was the recruitment of members who allegedly did not comply with the established procedures. This situation allowed the new members to participate in the election of the Executive Committee headed by Enma Molina, which generated internal tensions that culminated in a legal dispute.
Despite the irregularities, the ruling clarifies that it is not a criminal offense, which implies that it is up to the party's internal bodies to take the necessary measures. The case originated as a result of the local elections of 2022, when the current secretary-general, Enma Molina, competed with Mar Sánchez Contreras, who denounced the irregularities in the electoral process. Although the outgoing executive requested a postponement and a census review, her request was denied, which led Sánchez Contreras to take legal action. In the end, the court, upon recognizing the existence of a tainted census, has decided to return responsibility to the PSOE so that it addresses the matter internally.
